1. Operator and agreement
Tomegate is operated by Tomegate LLC, a Utah limited liability company. By creating an account, using checkout, or placing an order, you agree to these terms and the policies linked from them. You must provide accurate information, keep account credentials secure, and use Tomegate only for lawful purposes.
2. Service scope
Tomegate currently offers new and used physical books for delivery to supported addresses in the United States and Canada. Digital books and third-party marketplace sellers are not part of the current launch service. Available countries, currencies, fulfillment options, and other features may change over time. The options shown for a specific order are authoritative for that order.
3. Catalogue, condition, and availability
We aim to present useful edition, ISBN, format, condition, price, availability, and seller information. Images may be representative where catalogue imagery is used. Inventory can change between browsing and checkout, and Tomegate may refuse or stop an order where an item is no longer available or the order cannot be fulfilled safely or lawfully.
4. Pricing, promotions, tax, and currency
Tomegate currently prices and charges orders in U.S. dollars (USD). The checkout quote shows merchandise, eligible discounts, shipping, applicable tax, and the total before payment when those amounts are available. Promotions may have dates, eligibility rules, exclusions, quantity limits, or other conditions shown with the offer. The final order quote is authoritative for the amount charged.
5. Payment and order confirmation
Payment-card entry and processing are handled through Stripe. An attempted payment does not create a completed paid order unless Tomegate confirms the canonical order and payment state. Tomegate may decline or stop an order where checkout information is invalid, payment cannot be completed, fraud or security controls require intervention, inventory is unavailable, or fulfillment cannot reasonably proceed.
If Tomegate has captured money for an order that cannot be fulfilled, the applicable cancellation or refund workflow will be used. A refund is not complete merely because it has been requested or approved internally; provider confirmation remains authoritative for the financial completion state.
6. Shipping and delivery
Shipping coverage, estimates, tracking expectations, address requirements, and charges are described in the Shipping policy. Shipping estimates are not guaranteed delivery dates. Carrier events can be delayed or incomplete.
7. Cancellations
Eligible customers may request cancellation before the order has been handed to the carrier. A cancellation request pauses fulfillment while it is reviewed but does not itself cancel a paid order or complete a refund. Once the carrier has possession, pre-shipment cancellation is no longer available and the post-delivery return process may apply instead. See the Cancellation policy for details.
8. Returns and refunds
Return eligibility, deadlines, changed-mind postage, inspection, and refund processing are governed by the published Returns and refunds policy and the order-specific state shown in your account. Do not send books to Tomegate's public business mailing address unless Tomegate has specifically instructed you to do so for that return.
9. Prohibited activity
You may not misuse Tomegate, including by:
- attempting unauthorized access to accounts, systems, administrative tools, or data;
- using automated traffic in a way that disrupts or overloads the service;
- submitting fraudulent orders, payment information, support evidence, or identity information;
- interfering with security, rate limits, tracking, audit, or anti-abuse controls; or
- using Tomegate to violate another person's rights or applicable law.
10. Third-party services
Tomegate relies on third-party providers for services such as payments, tax calculation, address validation, shipping, tracking, email, infrastructure, security, and storage. Their systems may have separate terms, availability limits, and processing times. Nothing in these terms removes rights or remedies that applicable law requires.
11. Intellectual property
Tomegate's software, branding, original interface content, and service materials are protected by applicable intellectual-property laws. Book titles, covers, descriptions, publisher data, and other catalogue material may belong to their respective rights holders.
12. Liability and mandatory rights
To the extent permitted by law, Tomegate is not liable for indirect, incidental, special, or consequential losses arising from use of the service. Nothing in these terms excludes or limits liability, statutory warranties, remedies, or consumer rights that cannot lawfully be excluded or limited.
13. Governing law
These terms are governed by the laws of the State of Utah, United States, except to the extent that mandatory law applicable to you requires otherwise. This clause does not deprive a consumer of protections that cannot lawfully be waived.
